Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Vacay mobile application (the "Service" or "App") operated by Save Smart Group PTY LTD ("us", "we", or "our").
1. Acceptance of Terms
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Eligibility
By using the App, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are under 18 years of age, you confirm that you have obtained parental or guardian consent to use this App.
3. Service Description & Disclaimer (Crucial Notice)
Please read this section carefully. Vacay is a travel itinerary planning and organization tool. It is not a travel agency, booking platform, or travel advisory service.
No Guarantee: We do not guarantee the accuracy, completeness, or reliability of any travel information, recommendations, or itinerary suggestions provided by the App. Travel conditions, prices, availability, and local regulations may change without notice.
Third-Party Services: Any links, references, or integrations with third-party services (such as airlines, hotels, attractions, or booking platforms) are provided for convenience only. We are not responsible for the services, content, or policies of third parties.
Travel Advisory: The App does not provide official travel advisories. You are solely responsible for checking visa requirements, travel restrictions, health advisories, and safety information for your destinations through official government sources.
Limitation: You agree that you will independently verify all critical travel information (e.g., flight times, hotel reservations, tour bookings) and will not rely solely on this App for time-sensitive or mission-critical travel arrangements.
4. User Accounts & Data
No Account Required: You do not need to create an account to use Vacay.
Local Storage: Your itineraries, travel preferences, saved destinations, and custom notes are stored locally on your device. We do not sync this data to a cloud server.
Data Loss: If you delete the App, lose your device, or reset your device, your data and saved itineraries will be permanently lost. We cannot recover this data for you. We recommend exporting or backing up important itineraries before making any changes to your device.
5. Subscriptions and Free Trials
To access the full features of the App, you must purchase an auto-renewing subscription.

Length of Subscription: 1 Year (Auto-Renewing)
Price: $39.99 USD per year
Terms of Subscription:
Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Automatic Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price listed above ($39.99 USD).
Free Trial: We offer a 14-day free trial for new users. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable. Unless you cancel at least 24 hours before the end of the trial period, you will be automatically charged the applicable subscription fee.
Management & Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play after purchase.
6. Refund Policy
All sales are final. As this is a digital product with an immediate free trial period for evaluation, we do not offer refunds for partial months or unused services. Any refund requests must be directed to the Application Store (Apple or Google) and are subject to their specific terms and conditions.
7. User Content
The App allows you to create custom itineraries, add notes, upload photos, and save travel information.
Ownership: You retain ownership of all content you create within the App.
Restrictions: You agree not to use the App to store or share content that is illegal, promotes hate speech, or infringes on the intellectual property rights of others.
License: You grant us a license to process your content locally on your device for the purpose of providing the App's itinerary creation and organization features.
8. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Save Smart Group PTY LTD and its licensors. The Service is protected by copyright and other laws of the Republic of South Africa.
9. Limitation of Liability
To the fullest extent permitted by the law of South Africa: In no event shall Save Smart Group PTY LTD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of data, missed flights, lost reservations, travel disruptions, accommodation issues, or other intangible losses, resulting from your use of the Service. Our maximum liability to you for any claim related to the App shall not exceed the amount you paid to us for the Service during the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
11. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
